That is a scary incident, thank God nobody was seriously injured! I agree that the rule is not very clear, which only adds to the confusion - both here on the forum and on the water. I agree with Matt, the potential for misunderstanding the rule is dangerous and potentially deadly.
I would be curious to hear what the local coast guard has to say about that "rule" (if there's a CG presence on that reservoir), as it doesn't sound right to me, but to your original point, it's posted. It conflicts with what I know to be true, but it's of course best to steer clear anyway. Nobody wants to be involved in a collision on the water. I have been a little caught up in the technicality of "right of way," but the safest thing is to avoid other traffic (especially tubers & skiers, which can result in a person in the water) and yield when in doubt. Some common sense & common courtesy on the ski boat's part in avoiding other traffic would of course be appreciated, but is never guaranteed.
Not to mention, under rule 8, all vessels are responsible for reacting to avoid a collision when it becomes apparent that a collision is imminent, whether they have right of way or not.
